Welcome to Optimise Club, a platform operated by COGNIFIN LABS PRIVATE LIMITED ("Company", "we", "us", or "our"). These Terms and Conditions govern your use of our website, mobile applications, and services. By accessing or using Optimise Club, you agree to be bound by these terms.

1. Definitions

  • Platform refers to the Optimise Club website, mobile applications, and related services.
  • User refers to any individual who accesses or uses the Platform.
  • Opti Points refers to our loyalty currency earned through various activities on the Platform.
  • Vendors refers to third-party providers of products or services available through the Platform.
  • Gift Cards refers to digital gift cards available for purchase on the Platform.
  • Products refers to physical or digital items available for purchase on the Platform.
  • Platform Subscription refers to the premium membership offering additional benefits.
  • Affiliate Merchants refers to third-party retailers or service providers partnered with Optimise Club.

2. Eligibility and Account

2.1 Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use our Platform.

2.2 Account Creation

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.4 Prohibited Activities

You agree not to use the Platform for any illegal purpose, impersonate any person or entity, interfere with the Platform, or attempt to gain unauthorized access to any portion of the Platform.

3. Platform Offerings

Optimise Club provides access to multiple offerings, including but not limited to:

  • Reselling of Gift Cards
  • Sale of products (electronics, merchandise, etc.)
  • Access to affiliate merchants
  • Earning and redeeming Opti Points (our loyalty currency)
  • Platform Subscription for premium features

We act solely as an aggregator and facilitator. All products and services are provided by third-party vendors or merchants.

4. Gift Cards

4.1 Delivery

Gift Cards are delivered digitally via email and are also accessible on the Platform. Delivery is typically instant, but may take up to 7 working days in case of vendor delays.

4.2 Support

If you do not receive your Gift Card within 7 working days, contact support at contact@optimise.club for a refund or alternative solution.

4.3 Cancellation

Once an order is placed, it is non-cancellable and non-refundable if fulfilled.

4.4 Validity

Gift Cards depend from brand to brand, we would suggest contacting the brand for the same.

4.5 Usage

Gift Cards are subject to their own terms, including validity, usage, and may not be combined with other offers. You can find terms on every giftcard page.

5. Products

5.1 Delivery

Products (such as electronics and merchandise) may take up to 30 days for delivery.

5.2 Defects

In case of defects, you may raise a support query. Defective items may be eligible for replacement or repair at our discretion.

5.3 Returns

Products are otherwise non-returnable and non-refundable.

6. Platform Subscription

6.1 Benefits

Subscription unlocks additional benefits and premium features, subject to change at our discretion.

6.2 Cancellation

Subscription purchases are final and non-refundable once charged. You may cancel auto-renewal to avoid charges for subsequent periods.

7. Opti Points and Rewards

7.1 Earning

Opti Points are earned through eligible activities and transactions on the Platform.

7.2 Redemption

Points can be redeemed for various rewards, including Amazon Pay balance, premium rewards, partner airline/hotel points, travel bookings, gift cards, and carbon offsets.

7.3 Validity

The availability and value of rewards are subject to change without notice.

8. Affiliate Merchants

8.1 Tracking

Points for transactions with affiliate merchants are tracked based on merchant confirmation and may be impacted by your browser settings (e.g., cookie restrictions).

8.2 Limitations

We do not guarantee tracking or points for every transaction. If the merchant does not confirm your order, or if cookies are blocked, points may not be credited.

8.3 Liability

We are not liable for tracking failures or merchant decisions regarding order confirmation or points issuance.

9. Payment and Pricing

9.1 Payment Methods

We accept various payment methods as indicated on the Platform. You agree to provide accurate and complete payment information.

9.2 Pricing

All prices listed on the Platform are in Indian Rupees (INR) unless otherwise specified. Prices are subject to change without notice.

9.3 Taxes

Prices may not include applicable taxes. You are responsible for paying all taxes associated with your purchases.

9.4 Refunds

Refunds, where applicable, will be processed to the original payment method within a reasonable timeframe, subject to verification and vendor approval.

10. Third-Party Vendors and Liability

10.1 Vendor Services

All services and products are rendered by third-party vendors. We do not own, control, or guarantee their offerings.

10.2 Dispute Resolution

Any disputes or issues with vendors should be addressed directly with them. We will assist in facilitating communication but are not liable for vendor actions or omissions.

11. Limitation of Liability

11.1 Platform Role

Optimise Club operates solely as a platform that aggregates multiple vendors and services. The actual services are rendered by the respective vendors directly.

11.2 Disclaimers

We do not guarantee that the Platform will be uninterrupted, timely, secure, or error-free. We are not liable for any losses resulting from service interruptions.

11.3 Damages

In no event shall Optimise Club be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

12. Intellectual Property

12.1 Ownership

All content, trademarks, logos, and intellectual property displayed on the Platform are the property of Optimise Club or its licensors.

12.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use.

12.3 Restrictions

You may not modify, reproduce, distribute, or create derivative works based on any content from the Platform without our prior written consent.

13. Privacy and Communication

13.1 Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

13.2 Communications

By providing your contact information, you consent to receive communications from us, including emails, SMS, and push notifications related to your use of the Platform.

14. Termination

14.2 Termination by Optimise Club

We will make reasonable efforts to notify you of material changes to these Terms, but you are responsible for regularly reviewing these Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

These Terms constitute the entire agreement between you and Optimise Club concerning your use of the Platform.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

17.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.
